Would You Eat at an All-Nutella Restaurant? And Is It Even Legal?

A Nutella-themed restaurant called Nutelleria is slated to open soon on 5th Avenue between St. Marks and Warren (in the space last occupied by a cell phone store), and if nothing else, it sounds hilarious.

The owners, two guys named Andre and Gleb, are self-proclaimed "Nutella enthusiasts" who have a menu of crepes, croissants, breakfast pizzas, burritos, Nutella-bacon-banana waffle sandwiches, and more in the works, all using the popular chocolate-hazelnut spread, according to Park Slope Stoop.

They appear to have a fairly well-thought out business plan (there already seem to be Los Angeles and Miami locations in the works), but there's one potentially fatal flaw: its questionable legality. Ferrero, the parent company of Nutella, hasn't sanctioned the use of their name or likeness, and can potentially put a damper on the enthusiasm with one cease-and-desist letter. The company so far hasn't publicly commented on it, but you can only imagine that they're plotting a course of action, especially because there's already an officially-sanctioned Nutella Bar in Eataly.

As long as they make it clear that they are not affiliated with Nutella, theyre safe-though theyre use of the name in their store name as well as entire product line is riding a slim line. This usually comes up when youre openly using a trademarked product in your own product.

Nutella is litigious and could bleed these guys dry in legal fees even if their case fails on the merits. I hope they've already reached out to the company and worked something out.

Stupid idea but it won't last since Nutella is notorious for shutting things like this down.

We get the most asininenly stupid businesses opening in this neighborhood.

What a moron of a landlord who rented this place out to these fools. Legal issues aside, it's just a silly business idea and once the initial buzz dies, so will this place (and the landlord's bank account).

We live in a waterfront city and have so little in the way of seafood. How about some nice fish restaurants around here? Fish camp was overpriced and unwelcoming but I would think this neighborhood could sustain 2 or 3 really nice moderately priced seafood establishments.
Why do we have some crappy fish options around here? Even our fish markets are horrible. That one that moved from 7th ave to 5th ave is ghastly!

In terms of the actual idea- I think the detractors have seriously missed the boat on this one-theres similar thriving businesses in Italy and Germany as well as ones doing gangbuster business inside Eataly in Manhattan and Chicago. (though Eataly runs these under an express agreement with the Nutella company).

Anyone else feel like they're living in a neighborhood that's been dying for years? All we get are bad chains, burger spots, and whatever the hell a Nutella restaurant is.
